Abstract

The recent NSW Supreme Court decision of Mesenberg v Cord Industrial Recruiters Pty Ltd may have effectively put to rest this statutory initiative in augmenting the competence of private parties, including shareholders to act to prevent certain breaches of the Corporations Law. This is likely to have a significant impact on the enforcement of corporate law generally.
