Abstract

The article discusses the right of individuals or organisations to obtain access to information under FOI laws in light of the High Court's assessment of Ministerial non-disclosure certificates in a recent case. The author concludes the effect of the decision may be to unduly restrict FOI rights, and may inhibit the system of representative government contemplated by the Constitution.
