Abstract
The note which follows appeared with the latest issue of the Insolvency Law Journal and is reproduced here as a summary of the High Court's decision in Re Wakim. The decision has important consequences for judicial administration. Some jurisdictions have enacted legislation attempting to deal with the effect of the decision on orders made in the Federal Court and proceedings pending before that court; others have not.
